Terms & Conditions

These Terms & Conditions ("Terms") govern access to and use of the WonderMinds mobile application (the "App"), operated by Zylo Agency PTE. LTD. ("Zylo Agency PTE. LTD.", "we," "us," or "our"). By downloading, accessing, creating an account for, or subscribing to the App, you ("Parent," "you") agree to these Terms on your own behalf and on behalf of each child using the App under your account and supervision.

WonderMinds is intended for use by children ages 3–10 exclusively under the account, supervision, and consent of a parent or legal guardian. If you do not agree to these Terms, do not use the App.

The App is a children's educational product. Only an adult (18 years or older) with legal parental or guardian authority may create an account, subscribe, and consent to these Terms and our Privacy Policy on behalf of a child. By creating an account, you represent that you are such an adult and that you consent to each child's use of the App as described in our Privacy Policy.

WonderMinds is a subscription-based, ad-free educational app offering age-appropriate stories ("Wonder"), interactive challenges ("Think"), and creative activities ("Create") for children, guided by the in-app character Finn. Content is organized by theme and difficulty level (Discovery, Journey, Adventure) and may be personalized using information the Parent provides.

• You must provide accurate, current information when creating an account, and are responsible for maintaining the confidentiality of your credentials and for all activity under your account.
• A single subscription may support multiple child profiles (for example, for siblings), as permitted by your subscription plan. You are responsible for managing, adding, and removing child profiles linked to your account.
• You must notify us promptly of any unauthorized use of your account.

WonderMinds is offered on a subscription basis. Subscriptions are billed and managed through the Apple App Store or Google Play, and processed with the help of our subscription management provider, RevenueCat.

• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period, in accordance with Apple's and Google's respective billing policies.
• Cancellations must be made through your Apple ID or Google Play account settings, not through WonderMinds support, since we do not process payments directly.
• Refunds are subject to the refund policies of the Apple App Store or Google Play, as applicable. We do not directly issue refunds for amounts charged by those platforms.
• A single subscription covers all child profiles on your account; we do not charge per additional child profile unless stated otherwise at the time of purchase.
• We may offer free trials or promotional pricing at our discretion, subject to additional terms disclosed at the time of the offer.
• We may change subscription pricing prospectively, with notice as required by the applicable app store's policies.

You agree not to, and not to permit any user of your account to:

• Use the App for any unlawful purpose or in violation of these Terms.
• Attempt to reverse engineer, decompile, or otherwise access the App's source code, except as permitted by law.
• Interfere with or disrupt the App's operation, security, or servers.
• Misrepresent your identity or age, or falsely claim parental authority over a child.
• Copy, redistribute, or create derivative works from the App's content outside of normal personal, non-commercial, family use within the App.

All content within the App, including but not limited to stories, illustrations, characters (including Finn), audio narration, challenges, activities, branding, and software, is owned by Zylo Agency PTE. LTD. or its licensors and is protected by copyright, trademark, and other intellectual property laws. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the App for personal, non-commercial, family use only.

As between you and us, you (on behalf of your child) retain ownership of original creative content your child produces using the Create pillar (for example, drawings or recordings). By using the App, you grant Zylo Agency PTE. LTD. a limited license to store, sync, and privately display that content back to your own family's account across your own devices, solely to provide the App's features. We do not use child-created content publicly, do not share it with other users, do not license it to third parties, and do not use it to train any AI model.

Some content within the App may be generated or assisted by artificial intelligence tools. We review and curate AI-assisted content for age-appropriateness before it is published to the App, but such content is provided "as is" for entertainment and educational purposes and should not be treated as professional educational, medical, or developmental advice.

We provide a Parent Dashboard accessible only through your authenticated Parent account, allowing you to review your child's activity and progress across the App. You agree to use the Parent Dashboard only for its intended purpose of supervising your own child's use of the App.

As the account holder, you are responsible for supervising your child's use of the App, ensuring the App is age-appropriate for each individual child's needs, and monitoring screen time in line with your own family's preferences. WonderMinds is designed as a positive, ad-free alternative to unstructured screen time, but is not a substitute for parental judgment or professional educational assessment.

WonderMinds's stories, challenges, and activities are designed to support learning and development in a fun, engaging way, but are not a substitute for formal education, curriculum requirements, or professional evaluation of a child's developmental progress. We make no guarantee of specific educational outcomes.

You may stop using the App and cancel your subscription at any time through your app store account settings. We may suspend or terminate your access to the App if we reasonably believe you have violated these Terms, engaged in fraudulent activity, or misused the App — including any use that risks a child's safety or privacy — with notice where reasonably practicable.

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ZYLO AGENCY PTE. LTD. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP, AND OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID FOR YOUR SUBSCRIPTION IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM. NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW.

You agree to indemnify and hold harmless Zylo Agency PTE. LTD., its officers, employees, and service providers from any claims, damages, or expenses (including reasonable legal fees) arising from your breach of these Terms or misuse of the App, except to the extent caused by our own negligence or willful misconduct.

We are not liable for any delay or failure to perform resulting from causes beyond our reasonable control, including natural disasters, internet or infrastructure outages, acts of government, or failures of third-party service providers.

We may update the App and these Terms from time to time. If we make material changes to these Terms, we will provide notice via email and/or in-app notice before the changes take effect. Continued use of the App after changes take effect constitutes acceptance of the updated Terms.

These Terms are governed by the laws of Singapore, without regard to conflict-of-law principles. Any dispute arising from these Terms or your use of the App shall first be attempted to be resolved informally by contacting us at contact@wondermindsapp.com. If unresolved within a reasonable time, the parties will attempt good-faith mediation before pursuing litigation. Disputes not resolved informally or through mediation shall be subject to the exclusive jurisdiction of the courts of Singapore, except where applicable consumer protection law in your home jurisdiction provides otherwise or cannot be waived.

If you downloaded the App from the Apple App Store, you acknowledge that these Terms are between you and Zylo Agency PTE. LTD. only, not Apple, and Apple has no responsibility for the App or its content. Apple is not a party to these Terms and has no obligation to furnish any maintenance or support for the App. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App, if any, to you; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App. Apple is not responsible for addressing any claims relating to the App, including product liability claims, any claim that the App fails to conform to any legal or regulatory requirement, and claims arising under consumer protection or similar legislation. Apple is not responsible for the investigation, defense, settlement, or discharge of any claim that the App or your use of it infringes a third party's intellectual property rights. You agree to comply with the Apple Media Services Terms and Conditions, and Apple and its subsidiaries are third-party beneficiaries of these Terms, with the right to enforce them against you.

If you downloaded the App from Google Play, your use of the App is also subject to the Google Play Terms of Service. Google is not responsible for the App or its content, and any claims relating to the App should be directed to us at contact@wondermindsapp.com rather than to Google.

• These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the App.
• If any provision of these Terms is found unenforceable, the remaining provisions remain in full force.
• Our failure to enforce any right or provision is not a waiver of that right or provision.
• You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets, subject to Section 9 of our Privacy Policy.
• We will provide any notices required under these Terms via email to the address on your account and/or in-app notice.
